Last Will and Testament of
David Nutt (1797–1877)

indent.gifI, David Nutt of the town of Owego, County of Tioga & State of New York, considering the uncertainty of time here and being favored with a sound mind & memory do hereby make publish and declare this my last Will and Testament as follows, that is to say:

indent.gifFirst. – After the payment of my lawful debts, if any & my funeral expenses, I give & bequeath to my wife Susan Nutt the use of all my estate both real & personal of every name and nature during the term of her natural life. And I order & direct my Executor hereinafter appointed, that in case the use of my estate will not be sufficient to support her in a good & proper manner through sickness & health to sell of my real or personal estate a sufficient amount to support her, as my executor shall see fit & proper.

indent.gifSecond. – After the death of my wife Susan Nutt I order & direct my Executor to sell all my estate both real & personal, if not before sold and sell the same at public or private sale & the avails thereof to be divided equally among my six children. Sally Sherwood, Romanzo Nutt, Phidelia Farwell, Lorenzo Nutt, Morris Nutt, & Mary Jane Lane.

indent.gifLastly. – I do hereby nominate and apoint my son in law, Lindley Lane, sole Executrix of this my last Will and Testament with full power to him to sell my real and personal estate & to do and perform anything herein directed to be done.

indent.gifIn Testimony Whereof, I have hereunto set my hand & seal & publish and declare this & this only to be my last Will & testament in presence of the witnesses named below this second day of July one thousand eight hundred & seventy seven.

indent.gifThe forgoing instrument in one sheet was signed sealed declared & published by the said David Nutt as & for his last will & testament in presence of us who at his request & in his presence and in the presence of each other have subscribed our names as witnesses hereto this Second day of July 1877.
